3. Prices and Taxes
All prices displayed on our website are stated in euros (€).
Applicable taxes, including VAT where required, will be included or clearly indicated before you complete your purchase.
Shipping costs and any other applicable charges will be displayed before you place your order.
We reserve the right to change our prices at any time. Any price change will not affect an order that has already been accepted.
If we offer discounted products, the applicable discount and previous price will be displayed in accordance with applicable consumer laws.
4. Placing an Order
To place an order, you must:
-
Select the product you wish to purchase.
-
Add it to your shopping cart.
-
Provide the information required to process your order.
-
Select your preferred payment method.
-
Review your order and the applicable costs.
-

Before submitting your order, you will have the opportunity to review and correct any errors.
When you place an order, you are making an offer to purchase the selected products.
After submitting your order, you will receive an order confirmation by email. This confirmation acknowledges that we have received your order.
The sales contract is concluded when we accept your order and confirm that the product has been dispatched, unless applicable law provides otherwise.
We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including product unavailability, an obvious pricing error, suspected fraudulent activity or technical errors. If payment has already been made, we will refund the amount paid for any cancelled order.
5. Payment
Payment must be made using one of the payment methods available at checkout.
By submitting your payment details, you confirm that you are authorised to use the selected payment method.
Payment information is processed through the payment providers available in our store. We do not have access to your complete payment card details where these are processed directly by the relevant payment provider.
6. Shipping and Delivery
We ship to the European Union countries available at checkout. Shipping costs, destinations, processing and delivery times are described in our Shipping Policy.
Available shipping methods, delivery costs and estimated delivery times will be displayed during the checkout process.
Delivery times are estimates and may be affected by circumstances outside our reasonable control, including carrier delays, customs procedures, weather conditions or other unforeseen events.
If a specific delivery date or period has been agreed with you and we fail to deliver within the applicable period, your statutory rights under applicable consumer law will apply.
You are responsible for providing a complete and accurate delivery address. We are not responsible for delays or additional costs caused by incorrect or incomplete information provided by you.
7. Right of Withdrawal
If you are a consumer purchasing online, you generally have the legal right to withdraw from your purchase within 14 days of receiving the goods, without giving a reason.
The withdrawal period and its conditions are governed by applicable consumer protection law.
For more information about how to exercise your right of withdrawal, please see our Return & Refund Policy.
To exercise this right, inform us of your decision before the withdrawal period expires by a clear statement, for example an email to hello@iknacios.com. A model withdrawal form is available in our Return & Refund Policy, but its use is not mandatory.
We will then send you the return instructions and the address where the product should be returned.
Unless the product is defective, damaged or incorrect, you are generally responsible for the direct cost of returning the product when exercising the right of withdrawal, provided that you were informed of this before purchase.
Your statutory rights are not affected by our return policy.
8. Refunds
If you withdraw from your purchase, we will refund the payments received within 14 days of being informed of your decision, in accordance with our Return & Refund Policy and applicable consumer law.
Refunds will normally be made using the same payment method used for the original transaction, unless otherwise agreed with you or required by law.
Where you exercise your statutory right of withdrawal, any refund will include the standard delivery cost paid for the original order where required by applicable law. Additional costs resulting from your choice of a more expensive delivery option will not be reimbursed where permitted by law.
We may withhold a refund where legally permitted until we have received the returned goods or you have provided evidence that the goods have been returned.
9. Damaged, Defective or Incorrect Products
If you receive a product that is damaged, defective or different from the product you ordered, please contact us as soon as possible at hello@iknacios.com.
We will assess the issue and provide the appropriate remedy in accordance with applicable consumer protection law.
Your statutory legal guarantee rights apply independently of our voluntary return policy.
10. Legal Guarantee of Conformity
Products sold to consumers are covered by the applicable legal guarantee of conformity.
For new consumer goods sold in Spain, the statutory legal guarantee generally lasts three years from the date of delivery, without prejudice to any longer or otherwise applicable rights under the mandatory laws applicable to the consumer.
If the product does not conform to the contract, you may be entitled, depending on the circumstances and applicable law, to remedies such as repair, replacement, a price reduction or termination of the contract and reimbursement.
These rights apply regardless of whether the product was purchased at full price or at a discount.
Nothing in these Terms limits or excludes any mandatory consumer rights or legal guarantees that cannot legally be excluded or restricted.
11. EU Legal Guarantee Notice
The EU harmonised notice on the legal guarantee of conformity is displayed on our Legal guarantee page, in accordance with applicable European Union requirements.
The notice provides consumers with information about their legal guarantee rights for goods purchased in the European Union.
The mandatory harmonised notice is provided separately from these Terms of Service and does not replace or limit any statutory consumer rights.
12. Product Use
KIMU products must be used in accordance with the product information, instructions and intended purpose provided with the product or on our website.
We are not responsible for damage resulting from misuse, improper installation, modifications, negligence or use contrary to the instructions or intended purpose of the product, to the extent permitted by applicable law.
This does not affect your statutory rights relating to defective or non-conforming products.

18. Liability

In particular, nothing in these Terms affects your mandatory consumer rights, statutory guarantees or remedies provided by applicable consumer protection legislation.

19. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes to our business, products, services or applicable legal requirements.
The version applicable to your purchase will be the version in effect when you place your order, unless a change is required by law or otherwise applies to an existing contract.
The latest version will always be available on our website.
20. Applicable Law and Consumer Rights
These Terms are governed by Spanish law, without prejudice to any mandatory consumer protection provisions that apply to you under the laws of your country of residence.
If you are a consumer residing in another country of the European Union, nothing in these Terms is intended to deprive you of the mandatory rights and protections granted to you by applicable consumer law.
Any dispute will be subject to the jurisdiction of the courts that are competent under the applicable consumer protection laws.
